Certain products, including automotive lighting assemblies, structural body panels, and replacement mirrors, are available exclusively online through the website. To ensure correct application, you must verify compatibility using our Year/Make/Model (YMM) Fitment Search Engine prior to checkout.
⚠️ FITMENT & LIABILITY WARRANTY LIMITATION:
- User Data Responsibility: We are not liable for parts ordered based on incorrect user-input vehicle specifications or trim levels.
- Professional Installation Recommended: Automotive components are critical structural elements. We strongly recommend all products (especially LED headlights and electrical mirrors) be installed by an ASE-certified technician. We assume no liability for structural vehicle damage, labor costs, or bodily injuries resulting from DIY installation errors or improper product handling.
- Street-Legal Compliance: It is the buyer's responsibility to confirm local and state DOT/SAE regulations or California Air Resources Board (CARB) mandates regarding aftermarket lighting or styling upgrades in their specific jurisdiction.
SECTION 6 - ACCURACY OF BILLING & ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. This includes orders flagged by our fraud-prevention systems as matching reseller, distributor, or unauthorized drop-shipper parameters.
SECTION 7 - OPTIONAL TOOLS
We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. We provide access to such tools ”as is” and “as available” without any warranties.

In no case shall Merton Auto Parts, our directors, officers, employees, or logistics partners be liable for any consequential or indirect damages, including without limitation, towing fees, mechanics' labor charges, alternative vehicle rental costs, or downtime associated with the delivery, delayed shipment, or failure of any component procured through this platform.
⚠️ CRITICAL FREIGHT & LTL RECEIVING PROTOCOL:
For oversized items shipped via truck freight (LTL), the buyer assumes full contractual responsibility to visually inspect the outer pallet packaging and inner cargo before signing the carrier’s Bill of Lading (BOL). Signing the BOL without written damage notations constitutes definitive legal acceptance of the goods in 'Good Condition,' and subsequent claims for concealed transit damage will be barred under carrier regulatory frameworks.
SECTION 14 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless Merton Auto Parts and our parent, subsidiaries, affiliates, partners, and suppliers harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service.
SECTION 15 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law.
SECTION 16 - TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us.
SECTION 17 - ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms constitute the entire agreement between you and us.
SECTION 18 - GOVERNING LAW & JURISDICTION
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by, and construed in accordance with, the laws of the Hong Kong Special Administrative Region, without regard to its conflict of law principles.
Except as otherwise mandated by applicable local consumer protection laws within the United States, any legal action, dispute, or proceeding arising out of or relating to these Terms shall be instituted in a court of competent jurisdiction. To the maximum extent permitted by law, for merchant-to-merchant (B2B) or corporate wholesale transactions, parties agree to the non-exclusive jurisdiction of the courts of Hong Kong.
Notwithstanding the foregoing, if you are a consumer residing in the United States, nothing in these Terms shall limit, waive, or restrict your mandatory consumer rights under the laws of your state of residence. Any consumer-led disputes that cannot be resolved through our standard customer support protocols shall be subject to the jurisdiction of the state or federal courts located in the consumer's state of residence, or resolved via binding arbitration as permitted by local statutes.
SECTION 19 - CHANGES TO TERMS OF SERVICE
We reserve the right，at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes.
